General Terms and Conditions of Sale
Your stay with 4k Travel Peru is subject to the regulations governing tourism in Peru and Bolivia and to the following General Conditions, which complement these regulations and therefore prevail over them.
Article 1: Scope of application
These general conditions of sale apply to all trips and services offered by 4k Travel Peru, the organizer.
Article 2: General Information
- 4k Travel Peru is a legally constituted travel agency and tour operator based in Cusco, Peru. Consequently, it is subject to the laws and regulations in force governing the tourist activity and profession in this country.
- The registration for a trip implies full compliance with Peruvian and Bolivian tourism laws, our general conditions of sale and/or our special conditions of sale, as well as compliance with the instructions and recommendations set forth in the various notices attached to the travel documents.
- The client expressly acknowledges having read all the information related to the trip he/she has chosen thanks to the information provided by 4k Travel Peru.
- The client acknowledges having received clear, complete and accurate information about the weather situation of the tourist destinations included in the travel package, as well as the recommendations and/or advice provided by the company, which are available on the different virtual platforms of the institution, guaranteeing access in a timely and understandable manner.
Article 3: Registration
- At the time of registration, 4k Travel Peru will send you a form and a registration form, which must be completed. The reservation of the corresponding services becomes effective upon return of the form duly completed, signed and with the payment of a deposit of 70% or 50% of the total amount of the trip (as agreed with your travel consultant).
- The total balance of the trip amount must be paid no later than 30 days before the start date of the trip. If the reservation is made less than 30 days before the departure date, the total amount of the trip (100%) must be paid immediately.
- The receipt of the deposit implies the reservation of the corresponding services only to the extent of available seats.
- The contracting party and/or representative of the contracted travel program is responsible for the people registered in the same file.
- 4k Travel Peru requests the passport of the passengers only for the necessary purposes related to the management of reservations and tourist services that require official identification. The data will be treated confidentially and securely, ensuring compliance with personal data protection regulations.
Article 4: Cancellations
A. On the part of the client:
- 4.A.1.. If the customer has to cancel his/her trip for personal reasons (illness, death, etc.), the following penalties will apply:
- More than 60 days before the departure date, 15% of the total amount of his/her trip will be retained (excluding bank charges and costs related to the purchase of flights and domestic trains).
- From 59 days to 31 days before the departure date, 30% of the total amount of your trip will be retained (excluding bank charges and costs related to the purchase of flights and domestic trains).
- From 30 days to 15 days before the departure date, 50% of the total amount of your trip will be retained (excluding bank charges and costs related to the purchase of domestic flights and trains).
- From 14 days to 08 days before the departure date, 75% of the total amount of your trip will be retained (excluding bank charges and costs related to the purchase of domestic flights and trains).
- From 07 days to less before the departure date, 100% of the total amount of your trip will be retained.
- In the case of scheduling the Inca Trail trek, the amount of USD 250 per person will be retained
- . The entrance fee to Machu Picchu is non-exchangeable and non-refundable.
- 4.A.2 If one or more of the participants belonging to the same group of travelers must cancel their stay, the price will be recalculated according to the new final number of participants. The customer can choose between:
- Accept and confirm his agreement on the new proposed rate.
- Reject this new rate. Then the conditions set out in paragraph 4.A.1 will apply.
B. For 4k Travel Peru:
- 4. In case of external events of force majeure (social movements, meteorological, health disasters, etc.) that make the trip impossible, 4k Travel Peru offers the client the following options:
- Postpone the trip to a later date.
- Cancel the trip and be reimbursed for the amounts paid (excluding bank charges) and according to the costs related to the different cancellation policies of our service providers (airlines, train companies, hotels, institutions that manage tickets to tourist sites, etc). This reimbursement can only be made after the different service providers have reimbursed 4k Travel Peru for the amounts prepaid for the reservations.
- 4.B.2 Once registered, the client must communicate his/her personal information without errors (names, surnames, passport number, etc). If the information provided turns out to be incorrect and requires modification, 4k Travel Peru reserves the right to charge fees for this service.
Article 5: Modification of the program
A. On the part of the client:
- If the client modifies or interrupts his trip prematurely or decides not to carry out an activity foreseen in the program, no reimbursement will be made for the services not carried out and the services not initially specified will remain the responsibility of the client.
- If the client makes changes on his/her own without prior consultation or notification to the agency, whether in flights, hotels, travel itinerary or other related aspects, the agency will not be responsible for any inconvenience, loss or additional costs that may arise from such changes. In
- case of changes in dates by the client, we can reschedule the trip for a later date, however, the costs associated with changes in services will apply.
B. By 4k Travel Peru
4k Travel Peru reserves the right to modify the itinerary in case of external eventualities that generate interruptions (strikes, airport blockages, bad weather, etc.) without having to compensate its clients. Changes will be made in the interest of each participant, to ensure the smooth running of the trip. Additional expenses caused by these events will be the responsibility of the client.
Article 6: Rate modifications
4k Travel Peru offers its prices in US dollars (USD), currency used in Peru and international trade currency, in order to be aligned to the real cost of our service providers. In case of a significant fluctuation (increase of more than 5%) in the cost of services with an impact on the price of the stay (exchange rate between the US dollar (USD) and the Peruvian sol (PEN), the cost of transportation will suffer changes due to the price of oil, increase in entrance fees to tourist sites, etc.) between the time of signing this contract and one month before the start of the services, the organizer may be obliged to modify the defined rate. In these scenarios, the client has the following options:
- Accept and confirm his agreement to the new proposed rate.
- Cancel his trip. All payments made (excluding bank charges) will be refunded.
Article 7: Aircraft and luggage
- 4k Travel Peru disclaims all responsibility in case of delays, flight rescheduling, loss of transportation tickets, strikes or weather disturbances before, during and after the stay contracted through our agency: this also includes international flights not contracted by our agency, domestic flights included in the stay. Additional expenses caused by these events will be charged to the client.
- Luggage and personal belongings (cell phone, wallet, passport, etc.) are the full responsibility of the client for the duration of the trip. Therefore, in case of loss, theft or damage, the organizer is not responsible.
